1. Scope
These General Terms and Conditions ("GTC") of 4X-Digital GmbH govern the use of the 4X – Board Game App (iOS/Android) and related services. By using the App, you agree to these GTC. Diverging terms and conditions of the user are not accepted.

3. Contract Conclusion
The contract for the use of the free basic features is concluded upon download and first use of the App. The contract for premium features is concluded upon confirmation of the in-app purchase via the respective app store (Apple App Store / Google Play Store).
4. Payment Terms for App Stores
Payments for premium features are processed exclusively through the respective app store (Apple App Store / Google Play Store). The provider has no influence on the payment processes of the stores. Applicable store terms apply. Prices are displayed in the App and may vary by region and currency.

5. Right of Withdrawal (for Consumers)
As a consumer you have a right of withdrawal of 14 days (pursuant to § 355 BGB). If you expressly consent to immediate commencement of a digital service and acknowledge the lapse of withdrawal rights upon full performance, this right lapses accordingly. Detailed withdrawal instructions are provided in the EULA. For subscription cancellations, the respective app store terms apply.
6. Warranty Rights
For defects in the App, statutory warranty rights apply. The warranty period for consumers is 2 years. Claims for defects that were already present at time of download must be reported without undue delay. Cosmetic defects do not give rise to warranty claims.
7. Liability
The Provider is liable without limitation for damages caused by intent or gross negligence, for injury to life, body, or health, for defects concealed fraudulently, and in accordance with the German Product Liability Act. For simple negligence, the Provider is only liable for breach of a cardinal obligation (an obligation whose fulfillment makes proper performance of the agreement possible in the first place and on whose compliance the user regularly relies) and only to the extent of foreseeable typical damage.
8. Data Protection
The App processes personal data in accordance with the applicable Privacy Policy and GDPR. The privacy policy is available at www.4x-digital.com.
9. Jurisdiction and Applicable Law
German law applies, excluding UN Sales Law. For consumers within the EU, mandatory provisions of the consumer's country of residence also apply. For disputes with consumers, jurisdiction lies at the consumer's place of residence.
